Terms of use and packages

1. Scope

These terms apply to the use of the website mythaicity.com (MyThaiCity) and to all contracts for listings and packages between Design Planet, Inh. Simon Mast, Tulpenweg 4, 8107 Buchs ZH, Switzerland (“we”, “us”) and businesses or their representatives (“you”). By using the website or buying a package, you accept these terms.

Packages are intended for businesses. If you buy a package, you confirm that you are authorised to act for the business.

2. Our service

MyThaiCity is a travel guide and business directory for Thailand. Using the website is free of charge for visitors.

Most listings are created automatically from open data (see the privacy policy and the page Data sources). They are not verified by us or by the business unless they are marked “Verified by owner”. We do not guarantee that listings and travel guide articles are correct, complete or up to date. There is no entitlement to a listing, to a particular position in lists or to a particular number of visitors, calls or enquiries.

We may change, extend or discontinue features of the website. The website is available as far as technically possible; we do not guarantee uninterrupted availability.

3. Use of the website

You may use the website for personal and business information purposes. Automated mass retrieval of content (for example scraping or crawling to copy the directory) requires our prior written consent. This does not apply to search engines and similar services that respect our robots.txt file. The open data on which the listings are based are available from the original sources under their licences.

4. Reporting and deleting listings

Anyone can report a listing that is wrong, belongs to a closed business or should be deleted, using the report form at mythaicity.com/en/report/. If you give us your e-mail address, we reply within 5 working days. We check every report and correct or delete the listing after checking.

Businesses and the persons concerned can request the deletion of their listing at any time, free of charge. Deleted listings do not reappear with later data updates.

5. Claiming and adding a listing

Owners and authorised representatives can claim the listing of their business free of charge, correct the basic details and manage the listing. Businesses that are not yet listed can submit a listing using the form “Add a listing”; a basic listing is free of charge.

Before we activate a claim or a new listing, we may ask for proof that you are entitled to act for the business, for example a message from the phone number, e-mail address or social media account of the business. We may refuse a claim or a listing if the entitlement is unclear.

6. Your obligations and your content

You provide correct, complete and current information and inform us of changes.

You may only submit texts, photos, logos and links for which you hold the necessary rights and which do not infringe the rights of third parties, personality rights or applicable law.

You grant us the non-exclusive, royalty-free right to publish and store your content on the website, to adapt it for display (for example the image size) and to translate it into the languages offered on the website, for as long as your listing is shown. This right ends when the content is deleted.

7. Refusal, changes and removal by us

We may refuse, change or remove listings, content and Featured placements that are wrong or misleading, infringe rights, are unlawful, are of an adult nature or do not fit the purpose of the directory. If we remove paid content because of a breach of these terms, there is no entitlement to a refund.

8. Packages

We offer the following packages:

• Free (0 THB): basic listing with business name, category, address, directions, phone number and opening hours, as available from open data or provided by the owner. Listings from open data may also show a link to a website or social media page contained in the source data.
• Pro 1 year (2,900 THB for 12 months): everything in Free, plus the badge “Verified by owner”, your own description of up to 1,500 characters, up to 10 photos, links to your website and social media channels (for example Facebook, Instagram, LINE, WhatsApp) and the business name in Thai, Latin and Cyrillic script as provided by you.
• Pro 3 years (6,900 THB for 36 months, equivalent to 2,300 THB per year): everything in Pro 1 year, with up to 15 photos.
• Featured in a category (990 THB per month, or 9,900 THB for 12 months): placement at the top of the list of one category in one region, for example Restaurants & Cafés in Phuket.
• Featured in a region (2,900 THB per month, or 29,000 THB for 12 months): placement at the top of the pages of one whole region, that is the region page and all category lists of that region.

9. Featured placements

Featured is an add-on. It can only be booked for a listing whose Pro package is active for the whole Featured term. Featured is booked for one month or for 12 months; 12 months cost the price of 10 months.

Featured placements are paid advertising and are always labelled “Featured”. At most two Featured placements are visible on one page at the same time. If several businesses have booked the same placement, they are shown in rotation; at most three businesses share one placement.

We do not guarantee a particular number of impressions, clicks, calls or enquiries. We may refuse Featured placements with misleading or unlawful content.

10. Term, renewal and expiry

Paid packages are paid once, in advance, for their term. Pro runs for 12 or 36 months, Featured for 1 or 12 months, each from the day we activate the package after the payment has been confirmed. Packages do not renew automatically; there is no subscription.

We remind you by e-mail 30 days before a package expires. You can renew a package at any time; a renewal starts on the previous expiry date.

After expiry, the listing returns to Free and Featured placements end. We keep the Pro content (such as description, photos and links) for 90 days so that it can be shown again if you renew; after that it is deleted.

11. Prices, payment and activation

All prices are in Thai baht (THB) and include any applicable statutory value added tax (VAT). Design Planet is currently not entered in the Swiss VAT register; no VAT is shown.

You order a package with the order form on this website. We first check that you represent the business, usually by calling the phone number of the listing. If we can confirm this, we send you a payment link by e-mail; if not, we do not send a link and nothing is charged. Your order is not yet binding for either side.

The contract for a package is concluded when you complete the payment on the payment page and we confirm it by e-mail. Payment is made in advance, in Thai baht, via our payment service provider Stripe. You can pay by credit or debit card, also via Apple Pay or Google Pay. PayPal, PromptPay, TWINT and bank transfer are not available.

You enter your payment details directly with Stripe; we do not receive them. Your bank, card issuer or payment provider may charge fees for currency conversion.

We activate the package after the payment has been confirmed. As the website is static, changes become visible with the next update of the website. The confirmation e-mail serves as your receipt.

12. Refunds

On request, we refund the full price of a package if you ask for it within 14 days of the purchase, unless we have removed or restricted the listing because of a breach of these terms. The refund is made in the amount and currency paid, to the original payment method. The package then ends and the listing returns to Free.

After 14 days there is no entitlement to a refund, including if you have your listing deleted before the end of the term. Swiss law does not provide a general right of withdrawal for online purchases; mandatory statutory rights remain reserved.

If we discontinue the directory before the end of a paid term, we refund the unused part of the price pro rata.

13. Liability

We are liable only for intent and gross negligence, to the extent permitted by law. In particular, we are not liable for the correctness of listings and travel guide information, for decisions made on the basis of this information, for the services of listed businesses, for the content of linked websites or for interruptions of the website. Mandatory statutory liability remains reserved.

15. Changes to these terms

We may change these terms. The current version is published on this page. For existing paid packages, changes take effect 30 days after we have informed you by e-mail, unless you request the deletion of your listing within this period. Changes never affect the price or the scope of a package already paid to your disadvantage.

16. Language

These terms are written in English. If translations are published, the English version prevails.

17. Applicable law and place of jurisdiction

These terms and all contracts under them are governed by Swiss law, excluding its conflict-of-law rules. The place of jurisdiction is the Canton of Zurich, Switzerland. Mandatory places of jurisdiction, in particular for consumers, remain reserved.

If any provision of these terms is invalid, the remaining provisions remain valid.
